LIMITED WARRANTY

Rosenquist Inc. warrants that machinery to be delivered pursuant to this contract will be free of defects in workmanship or material for a period of one year from date of invoice. Should any failure to conform to this warranty appear within one year after the initial invoice, Rosenquist Inc., shall, upon notification thereof and substantiation that the machinery has been installed, maintained and operated in accordance with Rosenquist, Inc., recommendations correct such defects by replacement or repair in the following:

1. Defective workmanship by Rosenquist, Inc., Labor, Material, Expenses-no charge.

2. In the event a part purchased by Rosenquist, Inc., fails, the part will be invoiced and credit will be issued upon return and evaluation of defective part. (customer is responsible for freight charges for returns). In the event the purchaser requires Rosenquist, Inc. to replace the defective part, the labor will be at no charge. However, the expenses involved will be charged.

3. The only exception to the parts warranty will be for oscillator tubes,
which are under a separate limited warranty for the specific number of hours, which the manufacturer of said tubes warrants them, 3,000 hours or one year, whichever comes first, on a PRO-RATA BASIS.

THIS WARRANTY IS EXCLUSIVE AND IS IN LIEU OR ANY WARRANTY OF MECHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OF OTHER WARRANTY OF QUALITY, WHETHER EXPRESS OR IMPLIED, EXCEPT OF TITLE AND AGAINST PATENT INFRINGEMENT.

LIMITATION OF LIABILITY: THE SELLER SHALL NOT UNDER ANY CIRCUMSTANCES BE LIABLE FOR SPECIAL OR CONSEQUENTIAL DAMAGES, such as but not limited to damage or loss of other property or equipment, loss of profits or revenue, cost of capital, cost of purchased or replacement goods, or claims of customers of Purchaser for service interruptions. The remedies of the Purchaser set forth herein are exclusive, and the liability of Seller with respect of this contract, or anything done in connection therewith such as the performance or breach thereof, or from the manufacture, sale, delivery, resale, installation or use of any goods covered by or furnished under this contract whether arising out of contract, negligence, strict tort, or under any warranty, or otherwise, shall not, except as expressly provided herein, exceed the price of the goods upon which such liability is based.

LIMITED WARRANTY FOR REFURBISHED MACHINES

ROSENQUIST, INC., warrants that machinery to be delivered pursuant to this contract will be free of defects in workmanship or material for a period of 90 days from date of invoice. All New components installed during the rebuilding process will be warranted for 1 year. Should any failure to conform to this warranty appear within the warranty period, Rosenquist, Inc., shall, upon notification thereof and substantiation that the machinery has been installed, maintained and operated in accordance with Rosenquist, Inc. recommendations correct such defects by replacement or repair in the following:

1. Defective workmanship by Rosenquist, Inc., Labor, Material, Expenses - no charge.

2.
